Before the Embryo Transfer

During Pregnancy: Legal Injunction Strategy

  • At 12 weeks of pregnancy, the contract and pregnancy confirmation are submitted to the district court, officially notifying the authorities.
  • A legal injunction (amparo) process begins, typically lasting 4 to 6 months.

Depending on the judge’s ruling, a pre-birth judgment may be obtained, allowing the baby to be registered immediately after birth.

After Birth
If a pre-birth ruling was obtained, the baby is immediately registered under the intended parents’ names.

  • If the ruling is still pending, the process takes 2 to 4 additional weeks to obtain the court’s decision and register the baby without the surrogate’s name on the birth certificate.

This process applies to couples and single parents pursuing surrogacy. The estimated time for completing the baby’s registration varies depending on court workload, but in most cases, the birth certificate is issued within 15 days after birth.

  • Creating embryos using selected eggs and sperm.

Consular Process for Obtaining Nationality

Depending on the intended parents’ country, there are two possible pathways for obtaining the baby’s nationality:

Direct Path: Countries That Recognize Parentage from Birth

Some countries allow the baby to be registered as a citizen of the intended parents without additional legal procedures. The respective embassy will typically require:

  • Surrogacy agreement
  • Mexican birth certificate
  • Medical reports from pregnancy and birth

• Note on the United States:
If at least one parent is a U.S. citizen and there is a genetic link (DNA test), the baby can obtain U.S. citizenship directly. If no genetic link exists due to the use of donor eggs and sperm, a Mexican passport must first be obtained before applying for U.S. nationality.

If the intended parents’ country does not automatically recognize surrogacy or requires a genetic link, the process differs:

  1. First, the baby must obtain a Mexican passport.
  2. Then, the parents must travel with the baby to their home country on a tourist visa.
  3. Once there, a local attorney must be hired to initiate a parentage court process to grant the baby their nationality

Transfer the embryo in another country and continue the pregnancy in Mexico

If intended parents have already begun their fertility treatment in another country, they can transfer embryos to Mexico and continue the process with a surrogate here. We have a specialized team to coordinate the safe transport of embryos with certified companies.

Complete the entire process in Mexico using own or donated eggs

We offer a comprehensive program that allows the entire journey—from fertilization to birth—to take place in Mexico, using either the intended mother’s own eggs or those from a donor selected under strict medical and genetic standards.

Birth in the United States with support from our partner clinic
