What the process involves

Gestational surrogacy in Mexico is a legal pathway in which a gestational carrier carries a pregnancy created through in vitro fertilization, so that the intended parents are recognized as the baby's legal parents from birth. Since the 2021 Supreme Court rulings, it is available to every type of family: heterosexual couples, LGBTQ+ couples and single parents.
At Surrogate Mexico we coordinate the entire journey in one place: the legal strategy, the bank escrow, the IVF treatment at Ingenes Institute, obstetric care for the surrogate and the consular paperwork to travel home. Mexican legal framework backed by Supreme Court rulings. Surrogacy agreements are signed before the embryo transfer and notarized; a legal amparo enables expedited parentage so the baby is registered under the intended parents’ names.
Once your escrow is funded with the first payment, the preparation period begins. The escrow, administered by a regulated banking institution, gives you complete transparency over how and when funds are used.
Our specialists perform IVF: creating embryos with donor eggs and selected sperm (choosing the baby’s sex is legal in Mexico), advanced genetic testing, and embryo transfer to the surrogate under strict medical protocols.
Top-tier obstetric care, ongoing psychological counseling and frequent updates on the baby’s development and the surrogate’s well-being. From week 12 we begin the legal proceeding that recognizes you as the parents before birth.
Top-tier hospital with neonatal units, supervision by obstetrics and neonatology specialists, and postnatal care for the surrogate. Every detail of the delivery is coordinated in advance.
Once the court ruling is issued, the baby is registered with the Mexican Civil Registry and the birth certificate is issued naming you as the parents. We guide you through citizenship and consular procedures based on your country of origin.
